The man found not criminally responsible for killing his three children is asking to be allowed up to 28 days of unescorted leave from the psychiatric hospital where he is being held.
The lawyer for Allen Schoenborn has told the B-C review board during an annual hearing that his client has been on a "generally positive trajectory" since being granted day leave.
He also said allowing the director of the facility approval to grant overnight leave for Schoenborn would not necessarily mean he would receive it.
But a Crown lawyer Michelle Booker told the panel it does not want any changes to the existing conditions of Schoenborn's custody order.
