Watch: Maulana Assaults Woman Against Triple Talaq, 'Nikah Halala' During A Live TV Debate

    A cleric at Bareilly's influential Dargah Aala Hazrat seminary passed a fatwa on Monday asking people to boycott Nida Khan - an instant triple talaq victim, who has been running an NGO for women, who too are victims of the practice and nikah halala - or face "dismissal" from Islam.

     

    Though the copy of the written fatwa uses the name 'Hinda' instead of 'Nida', a cleric later told mediapersons that the fatwa has been passed for Nida.

     

    Responding to a query by Mufti Mohd Khurshid Alam Razvi, the imam of Bareilly Jama Masjid, an Aala Hazrat cleric, Mufti Afzaal Razvi, wrote while issuing the fatwa: "Halala is mentioned in the Quran. If Hinda does not apologise, she should be boycotted. Nobody should talk or greet her and people should stop eating with her, should not visit her if she is taken ill and if she dies, they should not read her last prayer or let her be buried in a graveyard."

     

    Nida Khan was divorced by her husband, Sheeran Raza, who is from the family of the head of Aala Hazrat, through instant talaq in 2016. She contested this in a civil court, which declared the divorce invalid.

     

    While discussing the issue, things went out of hand during a live debate on Zee Hindustan, when Maulana Ejaz Arshad Kajmi raised his hands against an advocate fighting against Triple Talaq

     

    Kajmi raised his hands against Farah Faiz, an advocate during a live debate. He has been arrested by the police from Zee Media’s office after a complaint filed by Zee Hindustan’s complaint.

     
     

    Faiz had said in the debate that triple talaq is not a form of divorce recognised in Quran.

     

    She said during the debate: “The practice of talaq-e-bidat without proper conciliation violates the basic right of every Muslim woman to live with dignity adding that Muslim women have become victims of gender discrimination in the absence of proper codified rules governing marriage, divorce and maintenance.

     

    Farah Faiz, now a Supreme Court lawyer, is one of the petitioners in the triple talaq case. She contended in her plea that “talaq-e-bidat (triple talaq) is not a form of divorce recognised in the Quran.

     

    Faiz runs an NGO Muslim Women’s Quest for Equality in Uttar Pradesh.

     
     

    "The Holy Quran is in mandatory language. It is not an advise. If we are adopting one procedure for marriage, why can't we have one procedure for talaq also?" she had told the court.

     

    She had also alleged that the Muslim clerics were running a parallel judicial system like the trial courts and the high courts and the clerics were forcing Muslims not to go to the courts.

     

    “Muslim women definitely are secure under Sharia law but what the Personal Law Board is doing (is) giving significance to triple talaq and nikaah halala which are not written in the Quran. The AIMPLB is not even a legal entity, it is just an NGO. They have a misleading name which has for years misguided both the Muslims and the Indian government,” she told SheThePeople.TV.

     
     
     

    In response, Khan said, "Who are they to oust me from Islam. I will be liable to take this issue directly to the Supreme Court if they try to exploit my constitutional, fundamental human rights. They are trying to spoil my image."

     

     

    Earlier in the day, a woman from Uttar Pradesh’s Shamli filed a complaint with the police, alleging that her husband gave Triple Talaq to her for giving birth to a girl child.
